When you are ready to take positive action toward getting out of debt, come to the Law Offices of Marshall D. Schultz. At our firm, we want to help you determine the best course of action to take to bring relief and decide if bankruptcy is right for you. Let us show you how an attorney from our legal team can help you find answers to your problems and give you the support you need.

Chapter 7 vs. Chapter 13

To qualify for Chapter 7, the most sweeping form of debt relief available, you must pass a means test. Failure to correctly calculate your financial assets and liabilities could prevent you from proceeding further. When this happens, it does not mean that bankruptcy is no longer an option, it simply means that Chapter 13 is more of a valid option for you. It brings advantages such being able to catch up on overdue mortgage payments within a five year period. While it may not cover as much as debt as Chapter 7, it is extremely helpful in bringing financial relief in various other aspects. The amount of debt discharge differs for each type of bankruptcy, but student loans, mortgages and any car loans will typically not be cleared from your debt.

Alternatives to Bankruptcy

If you are being harassed by creditors, we can pursue collections defense by invoking your rights under the Fair Debt Collection Practices Act. This law was enacted to protect those who are unjustly threatened by their creditors. In these situations, the best thing you can do is contact legal help to defend you from these types of situations.

If you are in danger of losing your home because of financial struggles, we can assist clients with foreclosure defense strategies such as short sale situations or a loan modification that would allow you to keep your house. A deed in lieu can also allow for this by allowing the bank to take the deed to your house.

We can work with your creditors to achieve a debt settlement or debt consolidation. Whether you choose bankruptcy or a form of debt negotiation, we urge you to take action now rather than live another day with the worries of owing large amounts of money and struggling with debt.

If you are unsure of how to restore your credit after filing, our legal team can walk you through the best way to get back to a place of financial stability. If you are still unsure if bankruptcy is right for you, talk to our lawyers to explore other alternatives.
